DUI or ARD in Pennsylvania
§ 3807 Accelerated Rehabilitative Disposition
INELIGIBLE FOR ARD; if the defendant has a prior DUI ARD or ADJUDICATION within 10 years; or, an individual suffered serious bodily injury related to the DUI; or there was a passenger under 14 years of age in the vehicle. SPECIAL EXCLUSIONS: Dauphin County: no prior felonies, only one misdemeanor over 10 years old; Cumberland County: BAC< .30, only one prior DUI over 10 years old, one felony over 15 years old, only one prior misdemeanor; Perry County: no prior DUI, other convictions ok.

- ARD FEE: DAUPHIN: $2500 / CUMB: $1500 / PERRY: $1500 (all fees are estimates)
- CRN EVALUATION & DUI SCHOOL
- DRUG & ALCOHOL EVALUATION (if required you must complete such counseling and provide a written successful discharge)
- ARD/DUI LICENSE SUSPENSION
- COMMUNITY SERVICE (CHECK WITH DA)
- VICTIM IMPACT PANEL (CHECK WITH DA)
- DRUG TESTING (CHECK WITH DA)
Less Thank .10 BAC: No Suspension
.10 To Less Than .16 BAC: 30 Day Suspension
Greater Than .16 BAC: 60 Day Suspension
Test Refusal: 60 Day Suspension
Accident: 60 Day Suspension
Drugs: 60 Day Suspension
Minor At Time Of Offense: 90 Day Suspension
PENNDOT License Restoration Fee must be paid before you can drive again.
